Terms of Service

These Terms of Service (“Terms”) govern your access to and use of CommStack (“the Service”), an AI-assisted message triage platform operated by OMII AI (“we,” “us,” “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
CommStack ingests messages from channels you connect (SMS via Twilio, email via Gmail), classifies them using AI, and can send automated replies on your behalf. You are responsible for the content of messages sent through the channels you connect.
2. Accounts & Eligibility
You must provide accurate account information, keep your credentials secure, and be authorized to connect any phone number or mailbox you link to the Service. You are responsible for all activity that occurs under your account.
3. Connected Accounts (Google & Twilio)
CommStack’s use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. You grant CommStack permission to read and send email on your behalf solely to provide the Service. You may revoke access at any time via your Google Account settings or by disconnecting the channel in the dashboard.
When you connect a Twilio number, you authorize CommStack to receive and send SMS messages through that number to provide the Service, and you agree to comply with Twilio’s and applicable carriers’ messaging policies.
4. Acceptable Use
You agree not to use the Service for any unlawful, abusive, or unsolicited (spam) messaging; to violate Twilio, Google, or carrier policies; or to attempt to disrupt, overload, or reverse-engineer the Service.
5. Billing
Paid plans are billed via Stripe on a recurring basis according to the plan you select. Fees are non-refundable except where required by law. You may cancel your subscription at any time from the billing portal; cancellation takes effect at the end of the current billing period, and you retain access to the Service until then.
6. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which describes what data we process and how. Message content is processed to provide the classification and reply features described above.
7. AI Output Disclaimer
Classifications and automated replies are generated by AI and may be inaccurate. You are responsible for reviewing automated actions taken on your behalf. The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.
8. Limitation of Liability
To the maximum extent permitted by law, OMII AI shall not be liable for any indirect, incidental, special, or consequential damages, or for any messages sent or missed by the Service. Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us for the Service in the twelve (12) months preceding the claim.
9. Termination
We may suspend or terminate accounts that violate these Terms. You may stop using the Service and cancel your account at any time.
10. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects when the most recent changes were made. Material changes will be communicated to account holders. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws provisions.
