Terms of Service

1. The Service

CommStack, operated by OMII Agency (“we,” “us”), helps you follow up with people you meet in person: capture a contact (business card photo, QR code, voice note, or typed entry), save them to your own address book and — if connected — your Google or Microsoft contacts, and send an AI-drafted follow-up message that you review first, from your own email account. By creating an account you agree to these terms.

2. Your Account

You are responsible for your account credentials and for all activity under your account. You must be at least 18 and provide accurate information. We may suspend accounts that violate these terms or put the Service or other users at risk.

3. Connected Accounts (Google & Microsoft)

Connecting Google or Microsoft authorizes CommStack to send messages you approve from your address, write captured contacts to your contact list, and read your calendar to name events — as described in the Privacy Policy. You can disconnect at any time in Settings. Your use of those providers remains governed by their own terms.

4. Contact Data & Your Warranties

Contacts you capture are people who did not sign up for CommStack. For their data you are the data controller and CommStack acts on your instruction. You represent and warrant that:

• you have a lawful basis to record and process each contact you capture, and where the law requires it you have given them notice;
• you will not upload purchased lists, scraped data, or contacts you did not personally meet or otherwise have a genuine relationship with;
• you will honor a captured person’s request to be corrected or erased.

You will indemnify OMII Agency against claims arising from contact data you captured or messages you sent.

5. Messages & Anti-Spam

Every message sends from your own account, under your own identity, only after you review and confirm it. You are the sender in law and in fact: you are responsible for complying with applicable messaging and marketing laws (including CAN-SPAM, CASL, and GDPR/ePrivacy where they apply) and for honoring recipients’ requests to stop hearing from you. Using CommStack for bulk unsolicited outreach is prohibited.

6. Billing

CommStack offers one paid plan at $25/month, billed through Stripe. Beta accounts are free until converted. You can cancel anytime via Settings → Billing; cancellation takes effect at the end of the current period and no partial-month refunds are given. Prices may change with at least 30 days’ notice.

7. AI Output

Drafts are generated by AI and can be wrong, awkward, or incomplete. You review every draft before it sends — what you send is your message and your responsibility. We make no warranty about the accuracy of AI output, business-card reading, or inferred details.

8. Acceptable Use

No unlawful use, no harassment, no impersonation, no attempts to breach or overload the Service, no reverse engineering, and no use of the Service to violate others’ privacy or intellectual-property rights.

9. Termination & Data

You can delete your account at any time in Settings → Account — deletion is immediate, irreversible, and removes your data as described in the Privacy Policy. We may terminate accounts for material breach; where practical we will give notice so you can export what you need first.

10. Disclaimers & Liability

The Service is provided “as is.” To the maximum extent permitted by law, OMII Agency’s total liability for any claim arising out of the Service is limited to the amounts you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages, or for the acts of third-party providers (Google, Microsoft, Stripe, Anthropic, Supabase, Vercel).

11. Changes & Contact

We may update these terms; material changes will be posted here with an updated date, and continued use after that constitutes acceptance. Questions:legal@omii.agency.
